RE: The tariff classification of Frovatriptan Succinate (CAS-158930-09-7) in bulk form, from Taiwan

Dear Ms. Forstenzer:

In your letter dated January 18, 2010, you requested a tariff classification ruling.

The subject product, Frovatriptan Succinate, is a selective 5-hydroxy-tryptamine1 (5-HT1B/1D) receptor subtype agonist. It is indicated for the acute treatment of migraine attacks with or without aura in adults.

The applicable subheading for the Frovatriptan Succinate in bulk form will be 2933.99.5590 Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Heterocyclic compounds with nitrogen hetero-atom(s) only: Other: Other: Aromatic or modified aromatic: Other: Drugs: Drugs primarily affecting the central nervous system: Analgesics, antipyretics and nonhormonal anti-inflammatory agents: Other.” Pursuant to GN13 HTSUS, the rate of duty will be free.
